Marriage (Registration of Buildings) Act 1990

An Act to allow a building to be registered for the solemnization of marriages under section 41 of the Marriage Act 1949 notwithstanding that it forms part of another building.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1Registration of buildings forming part of other buildings

In subsection (1) of section 41 of the [1949 c. 76.] Marriage Act 1949 the word “separate” is hereby repealed and for subsection (7) of that section there shall be substituted—

A building may be registered for the solemnization of marriages under this section whether it is a separate building or forms part of another building.

In consequence of subsection (1) above—

a

in the [1969 c. 38.] Sharing of Church Buildings Act 1969, in section 6(4)(a) the words “other than paragraph 1 thereof” and paragraph 1 of Schedule 1 are hereby repealed; and

b

in paragraph 2 of that Schedule for the words “the said section 41” there shall be substituted the words “section 41 of the Marriage Act 1949 (hereinafter referred to as “the Act”)”.

2Short title and commencement

This Act may be cited as the Marriage (Registration of Buildings) Act 1990.

This Act shall come into force at the end of the period of two months beginning with the day on which it is passed.
