Caldey Island Act 1990

An Act to provide for the islands of Caldey and St. Margaret’s in the county of Dyfed to be included in the district of South Pembrokeshire for the purposes of local, parliamentary and European elections and for the purposes of local taxation; to include those islands in the districts of the Pembrokeshire coroner and the Pembrokeshire Health Authority; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—
1Elections

Caldey Island and St. Margaret’s Island in the county of Dyfed (in this Act together referred to as “Caldey”) shall be included in the district of South Pembrokeshire for the purposes of the law relating to local government elections and to parliamentary and European Parliamentary elections.

St. Margaret’s Island (as well as Caldey Island) shall be part of the electoral division of Tenby for the purposes of the election of councillors for that county; and Caldey shall be part of—
a
the ward of Tenby for the purposes of the election of councillors for that district;
b
the parliamentary constituency of Pembroke; and
c
the European Parliamentary constituency of Mid and West Wales.

Caldey shall be a parliamentary polling district and a polling district for the purposes of the election of county and district councillors.

Caldey shall also be included in the district of South Pembrokeshire for the purposes of the law relating to eligibility for election to and membership of a local authority.

For the purpose of enabling a person to be included in the registers of parliamentary and local government electors published for the years beginning with 16th February 1990 and 16th February 1991—
a
subsections (1) to (3) above shall be deemed to have been in force on 10th October 1989 and 10th October 1990 (the qualifying dates in relation to those registers);
b
the reference in section 11(2) of the Representation of the [1983 c. 2.] People Act 1983 to the correction of a register shall include a reference to any addition made by virtue of this section; and
c
the relevant provisions of the Representation [S.I.1986/1081.] of the People Regulations 1986 apply accordingly.
2Local taxation
Caldey shall be included in the district of South Pembrokeshire for the purposes of the law relating to the community charge, to precepts and to non-domestic rating.
3Coroner’s and health authority districts
Caldey shall be included in the district of the Pembrokeshire coroner and the district of the Pembrokeshire Health Authority.
4Savings and transitional and supplemental provisions

The foregoing provisions of this Act are without prejudice to the powers exercisable under—
a
Part IV of the [1972 c. 70.] Local Government Act 1972 (changes in local government areas);
b
the [1986 c. 56.] Parliamentary Constituencies Act 1986, Schedule 2 to the [1978 c. 10.] European Parliamentary Elections Act 1978, and sections 18 and 31 of the Representation of the People Act 1983 (designation of and alteration of polling districts);
c
section 4 of the [1988 c. 13.] Coroners Act 1988 (alteration of coroners districts); and
d
section 8 of the [1977 c. 49.] National Health Service Act 1977 (determination of health authority districts).

Part IV of the said Act of 1972 shall apply as if Caldey were included in the district of South Pembrokeshire for all purposes but any order under that Part providing for its inclusion in a different district may provide for its inclusion to be subject to the same limitations as by virtue of this Act apply to its inclusion in South Pembrokeshire.

The Secretary of State may by order make such transitional and supplemental provisions with respect to Caldey as he considers necessary or expedient in consequence of the provisions of this Act.

The power to make orders under subsection (3) above shall be exercisable by statutory instrument subject to annulment in pursuance of a resolution of either House of Parliament.
5Short title
This Act may be cited as the Caldey Island Act 1990.
